By using the website at www.sanjacintoconcretecompany.com, requesting a service estimate, or entering into a service agreement with San Jacinto Concrete Company ("Company," "we," "us," or "our"), you agree to these Terms and Conditions. If you do not agree, do not use our website or services. These terms apply to all visitors, customers, and others who access our website or engage our services.
San Jacinto Concrete Company provides concrete contracting services in San Jacinto, CA and surrounding areas. Our services include, but are not limited to, concrete driveway building, patio construction, foundation installation, sidewalk building, and related concrete work.
We reserve the right to decline any project or service request at our discretion. All work is performed by licensed contractors in accordance with applicable California state and local codes.
Estimates provided by San Jacinto Concrete Company are based on the information available at the time of the site visit or inquiry. An estimate is not a guaranteed final price. The final price may be adjusted if actual conditions at the job site differ materially from what was described or observed during the estimate process - for example, if hidden soil conditions, buried utilities, or structural issues are discovered during work.
Any change to the scope of work requested by the customer after the estimate has been accepted may result in an adjusted price. We will communicate any changes in writing before proceeding with additional or modified work.
Prices in any estimate are valid for 30 days from the date of issue unless otherwise stated. After 30 days, material and labor costs may have changed, and a new estimate may be required.
Once a project is scheduled, we ask that customers notify us at least 48 hours in advance if they need to reschedule. This allows us to make other arrangements and avoid losing scheduled labor time.
We reserve the right to reschedule a project due to weather conditions, material delays, or other circumstances outside our control. We will notify you as soon as possible and work with you to find an alternate date.
If a customer cancels a scheduled project after materials have been ordered or permits have been pulled, the customer may be responsible for the cost of materials and any permit fees already incurred.
Payment terms are stated in the written service agreement provided before work begins. In general, a deposit may be required before scheduling, with the remaining balance due upon completion of the project.
We accept payment by check, cash, and other methods as agreed in writing. Payment is due on the date specified in the service agreement. Late payments may be subject to a late fee as described in the agreement.
Work may be paused or stopped if a scheduled payment is not received on time. San Jacinto Concrete Company reserves the right to file a mechanics lien on the property for unpaid services in accordance with California law.
To allow us to do our best work, customers are responsible for:
San Jacinto Concrete Company is not responsible for damage or delays caused by the customer failing to meet these responsibilities.
We stand behind our work. Any warranty offered is stated in the written service agreement for your specific project. Warranty coverage is limited to defects in materials and workmanship under normal use and conditions.
The following are not covered under any warranty: damage caused by extreme weather events, seismic activity, tree root intrusion, soil movement beyond normal seasonal variation, improper use of the surface, or modifications made by anyone other than San Jacinto Concrete Company after project completion.
EXCEPT AS STATED IN A WRITTEN SERVICE AGREEMENT, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT SERVICES WILL BE ERROR-FREE OR THAT RESULTS WILL MEET ANY PARTICULAR STANDARD NOT EXPLICITLY AGREED UPON IN WRITING.
To the maximum extent permitted by law, San Jacinto Concrete Company is not liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services, including lost profits, loss of use, or damage to property not directly caused by our negligence.
Our total liability for any claim arising from a project is limited to the amount paid by the customer for that specific project.
If a dispute arises between you and San Jacinto Concrete Company, we encourage you to contact us directly first. Many issues can be resolved quickly with a phone call or email, and we are committed to working with our customers in good faith.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing any other legal remedy. If mediation fails, any legal action must be filed in the appropriate court located in Riverside County, California.
Nothing in this section prevents either party from seeking injunctive relief or other emergency legal remedies where appropriate.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising out of or related to these terms or our services shall be brought in Riverside County, California.
